?Everyone has the right to respect for his private and family life, his home and his correspondence.? ? European Convention on Human Rights, Article 8, 1950\u00a0<\/p>

GDPR translates this principle for the digital era, as personal data processing has permeated everyday life.\u00a0<\/p>

New technologies, new\u00a0privacies?<\/strong><\/h2>

GDPR will be a decade old next year, in\u00a02026. Since then, technologies have changed drastically, as has the online\u00a0behaviour\u00a0of citizens.\u00a0<\/p>

With this pace of change, the question is not whether GDPR?s values still apply, but how they meet today?s technologies and practices.\u00a0<\/p>

The General Data\u00a0Protection Regulation,\u00a0or, in full,\u00a0Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016, has\u00a0been\u00a0in force\u00a0since 25 May 2018. The GDPR focuses on the protection of natural persons with respect to the processing of personal data and\u00a0regulates the\u00a0movement\u00a0of such data. It embodies European values of individual agency and freedom, and it\u00a0aims to\u00a0protect\u00a0individuals? rights in a fast-paced digital transition.\u00a0<\/p>

These values\u00a0translate into\u00a0several\u00a0core principles: lawfulness, fairness, transparency, purpose limitation, data\u00a0minimisation, accuracy, storage limitation, integrity and confidentiality, and accountability.\u00a0<\/p>

The European Union has been at the forefront on\u00a0the protection of\u00a0citizens? rights in an increasingly digitised\u00a0world, and the GDPR is one of the most important testimonies to this, along with the flagship Digital Services Act and Artificial Intelligence Act, to\u00a0name but a few. The GDPR\u00a0has\u00a0been\u00a0considered\u00a0a clear example of the ?Brussels effect\u2019,\u00a0being often referred to as the\u00a0\u201cgold standard\u201d\u00a0legislation on data protection.\u00a0\u00a0<\/p>

However, in the last few years\u00a0an\u00a0increasingly\u00a0complex global context has pushed the European Commission to pursue\u00a0competitiveness, especially through\u00a0regulatory simplification. This is particularly true for the digital sector. This simplification push, while aiming to allow the Bloc to compete on the global stage,\u00a0is feared\u00a0to\u00a0have\u00a0the potential to reduce the\u00a0safeguards\u00a0and protections on European citizens? rights.\u00a0<\/p>

As shown by recent Proposals by the European Commission, for instance the\u00a0\u6570\u5b57 \u7efc\u5408 \u603b\u7ebf<\/a>, as technologies scale and diversify, policymakers are asking whether the rules need targeted tuning or broader reform.\u00a0<\/p>

The GDPR is undergoing revisions to simplify compliance for small and medium-sized enterprises and to improve enforcement procedures.\u00a0Prior\u00a0to the release of the Digital\u00a0Ominbus\u00a0Proposal, Commissioner\u00a0Michael\u00a0McGrath\u00a0(Democracy, Justice, the Rule of\u00a0Law\u00a0and Consumer Protection),\u00a0confirmed that the GDPR would\u00a0undergo a simplification process, which\u00a0eventually came to\u00a0encompass a\u00a0proposed\u00a0reduction of record keeping requirements also for companies\u00a0with 250 employees or more, raising the upper limit to 749.\u00a0\u00a0<\/p>

According to MEP Axel Voss,\u00a0Europe faces\u00a0a clear choice\u00a0on GDPR reform<\/a>: ?either we revise the GDPR to enable digital innovation while safeguarding privacy, or we continue down a path that leads to stagnation and increasing reliance on foreign technology.? In his view, revising the GDPR is essential to unlock Europe?s digital future.\u00a0<\/p>

The release of the Digital Omnibus proposal,\u00a0however, has\u00a0also raised\u00a0concerns among privacy\u00a0advocates<\/a>, arguing that the amendments proposed would risk jeopardising cornerstone measures\u00a0protecting the privacy of European citizens.\u00a0Taken together, these signals sketch a spectrum of reform, from simplification for SMEs to broader changes intended to support innovation while preserving rights.<\/p>

\u673a\u68b0\u5316\u4e2d\u5fc3\u8fa9\u8bba\uff1a \u5b89\u5168\u3001\u626b\u63cf\u3001\u9690\u79c1<\/strong><\/h2>

During its\u00a0presidency\u00a0of the Council,\u00a0Denmark\u00a0has\u00a0given high priority\u00a0to the\u00a0Regulation on Child Sexual Abuse Material detection\u00a0(CSAM).\u00a0<\/p>

In 2023, the European Commission proposed a regulation that would require digital communication apps to scan the communications of EU citizens, even if they were not under suspicion, the CSAM proposal. This proposal has faced criticism from academics, privacy regulators, and the Council of the European Union?s internal legal experts for violating the essence of the fundamental right to privacy.\u00a0However, it is relevant to point out that\u00a0privacy-preserving approaches have been proposed, where checks would be done on the\u00a0user\u2019s\u00a0device,\u00a0minimising\u00a0(even eliminating) the transfer of personal identifiable information.\u00a0<\/p>

While adoption had been initially targeted for October 2025, further debate pushed back the potential adoption of an amended version of the\u00a0initial\u00a0legislative proposal to April 2026.\u00a0<\/p>

A question\u00a0remains: what\u00a0will\u00a0the\u00a0implications for\u00a0data protection\u00a0be\u00a0after the legislative proposal\u00a0is\u00a0amended?\u00a0\u00a0<\/p>

While the proposal has come to include more privacy and proportionality guarantees, its impact on data protection\u00a0will need to be examined more closely as its legislative procedure advances\u00a0and the key principles of the proposal\u00a0become\u00a0clearer.\u00a0<\/p>

Every generation\u00a0has to\u00a0choose its most suited online and offline environment, and how to feel as comfortable as possible in the trade-off between what you receive and what you share.\u00a0<\/p>

The next months\u00a0have\u00a0indeed\u00a0the potential to reshape\u00a0how the European Union positions itself on the balancing act between data protection, law\u00a0enforcement\u00a0and innovation.\u00a0<\/p>
